India Decides To Continue Imposing Anti-Dumping Duties On Chinese Linen Yarn

On October 12, 2023, the Taxation Bureau of the Indian Ministry of Finance issued Circular No. 10/2023-Customs (ADD), which stated that it accepted the first anti-dumping sunset review recommendation made by the Indian Ministry of Commerce and Industry on July 16, 2023, on flax yarn (FlaxYarnoBelow70LeaCountorbelow42nm) originating or imported from China with a diameter of 70 or 42, and decided to continue to impose anti-dumping duties on the products involved in China for a period of 5 years, with a tax amount of 2.29-4.83 US dollars per kilogram, Among them, the producers/exporters Jiangsu Jinyuan Flax Co., Ltd., Zhejiang Jinyuan Flax Co., Ltd., and Zhejiang KingdomLinen Co., Ltd. are all at $2.42/kg, Yixing Shunchang Linen Textile Co., Ltd. is at $2.29/kg, and other Chinese producers/exporters are at $4.83/kg. This measure shall take effect from the date of publication of this notice in the official gazette. This case involves products under Indian customs codes 530610 and 530620.

On February 7, 2018, the Indian Ministry of Commerce and Industry issued a notice stating that in response to the application submitted by Jaya ShreeTextiles, a domestic Indian enterprise, an anti-dumping investigation will be conducted against linen yarn originating or imported from China. On September 18, 2018, the Indian Ministry of Commerce and Industry made a final affirmative anti-dumping ruling on the case. On October 18, 2018, the Indian Ministry of Finance decided to impose an anti-dumping duty of $0.50-4.83 per kilogram on Chinese products involved in the case (see Customs Notice No. 53/2018 Customs), which is valid for 5 years and expires on October 17, 2023. On March 31, 2023, the Indian Ministry of Commerce and Industry announced that in response to the application submitted by Indian domestic enterprises Grasim Industries Limited (Jaya ShreeTextiles) and Sintex Industries Ltd., the first anti-dumping sunset review investigation will be launched against flax yarn of 70 deniers or less originating or imported from China. On July 16, 2023, the Indian Ministry of Commerce and Industry made a positive final ruling on the case.
